WILL OF EDWARD FRISBYE The last Will and Testament of Edward Frisbye, of Branford.

I, being weak in body, but perfect in understanding and memory, do make this my last will for the disposing of my worldly goods. I give to my son John so much as to make what he hath had already fifty pounds; he having already received about five and thirty pounds. I give to my son Benoni two acres home lot; viz. the middle lot, and two acres of my pasture in the mill quarter, and my cow meadow on Indian Neck; two acres of Beaver Swamp; two acres of meadow at Scotch Leap, which is yet unfenced; four acres at Hopyard Plain; two acres of upland at Knocking Hollow; viz. what he now improves and what lies between that land and Great Plains path; nine acres of cow pasture land, as it shall be laid out on the north side of Thomas Wheadow's swamps; only I reserve the useof the well which is in Benoni's lot, for those that shall live on either of my home lots, so long as any of teh Frisbyes or any of their heirs shall live thereon. I give to my son Jonathan one acre and a half of meadow at Oyster Neck, as also my lots of upland on Dutch House Neck and Oyster Neck or near thereunto. I give to my daughter-in-law Rebekah Tyler, relict of my son Samuel, five shillings. The remainder of my lands both upland and meadow, with the buildings thereon, with all other divisions of land, to be equally divided between my five children that now live with me; viz. Abigail, Josiah, Calib, Silence, and Ebenezer, only Ebenezer and Silence to have the pasture lot in the mill quarter for their part of their proportion, and reserving the liberty for Abigail and Silence to live in my new dwelling house if they so choose, so long as they shall remain unmarried. I also desire thte Rev. Mr. Samuel Russell and my sone John Frisbye to be guardians to my sone Ebenezer, and to act for him in the dividing of the lands if there be need before he come to the age of one and twenty years. Only what is the reaminder of my lot in the Beaver Swamps (when my son Benoni hath had his two acres which shall be on the north side of my lot) shall be equally divided between my three youngest sons, Josiah, Calib and Ebenezer. It is also my will that my movable estate shall be equally divided (when my son John hath had the remainder of his fifty pounds) between six of my children, Abigail, Josiah, Calib, Hannah, Silence and Ebenezer, only my two sons Josiah and Calib to have my teams, that is my oxen and hosre with the furniture of the rooms, they to have it upon an apprisal. And if it be more than their proportion, then they to repay what is due dfrom them to the other four children above mentioned; and if wanting, to be made up out of the movables, only I give to my grandson Edward Frisbye a heifer two years old. This is my will also that my corn and provisions laid in for the present year with six fatting swine, and a fat beast be for my five children to live upon; viz. Abagail, Josiah, Calib, Silence and Ebenezer; and to pay my debts and if there want to pay my debts, then what is wanting shall be paid out of the movables. And I do make my son John Frisbye executor of this my will, with my hand and seal, this five and twentieth day of October, A.D. One Thousand Six Hundred and Eighty-nine. Edward Frisbye (so spelled in his will), was one of the earliest settlers of the town of Branford (originally Totoket) in the colony of New Haven, where he is said to have married in 1644, and is on record as having entered his name for land Decmeber 15, 1645. No record of his birth has been found; he died in Branford May 10, 1690. His place of birth, the names of his parents, and whence he came to New England are also unknown.

Nothing of authentic record is known of him prior to his application for land in 1645. His name is not in the published lists of immigrants of the seventeenth century. Hotten's "Original Lists of Persons" (who went from Great Britain to the American plantations 1600 - 1700, John Camden Hotten, 1874) contains the name Frisbie or Frisby, but twice. Richard Frisbie, who arrived in the Jonathan in 1619, aged thirty-four, and appears in the Virgina musters in the retinue of Sergeant William Barry, and Elizabeth Frisby, who came to Virginia in the Safety in 1635. It is possible, however, not to say probable, that Edward Frisbye, of Branford, was a son of this Richard Frisbie, born on shipboard or after his parents reached Virginia, and that in his early manhood he made his way with others to the colony of New Haven.

Neither is it know to a certainty whom he married. It is believed that he was married at least twice, perhaps three times. At any rate, three names are given: Hannah ---------, in 1644, Abigail Culpepper and Frances England, daughter of Jonathan England. Teh fact that he mentions no wife in his will, would indicate that none was living when the will was made, in 1689.

Of his life in Branford little is known beyond the meager details that may be gleaned from the town, church, and other public records. He had a family of eleven children, some of whom, like himself, were active in the affairs of plantation and church; and his numberous descendants have included many of ablility and eminence. He was evidently a thrifty farmer, a substantial citizen, a considerable landowner, and well-to-do, not to say wealthy, for his time.

He was a Congregationalist of the early puritan type, though less narrow, apparently, and more tolerant than many of his contemoraries. In 1767, when the Reverand Abraham Pierson and his following had withdrawn from the plantation because under the new charter of the united colonies others than church members were admitted to the rights and privileges of freemen and allowed to participate in the administration of public affairs - a defection that seriously affected the community and left the Church disorganized and without a settled pastor for twenty years, Edward Frisbye and his eldest son John were among the signers of the "New Plantation and Church Covenant of Brainford". Those who entered into this covenant not only reaffirmed their loyalty to the essential principles of Congregational polity and expressed their determination to support the services and institutions of the Church as best they could, but they accepted the new conditions and acquiesced in them. By taking this stand and by adopting practical measures to maintain it, they proved themselves to be no less true to their convictions, no less courageous, and withal of broader minds than those who had gone out from among them to found a new theocratic community in the wildernss of New Jersey.
